CHILD ABUSE

Homicide/Child Abuse: A new father retained me when his infant son was hospitalized in a coma. The State believed the child had been shaken to cause brain injury. The court restricted the parents' access to their child in the hospital. We obtained visitation to permit the young parents to see and hold their baby, who soon died. A later autopsy revealed no evidence of abuse. No charge was filed.

Homicide/Self-Defense: My teenaged client came home from school, got a gun, and sat in a chair waiting for his father to come home from work. He shot and killed him when he walked in the door. We used experts to explain why ten years of horrific abuse by the father against my client, his mother and brother, and the signals of imminent violence from the father made this a case of self-defense.

Assault of a Child: My client was convicted of assaulting her infant daughter. The court instructed the jury on a crime that the State never charged. The Court of Appeals reversed the conviction.

Assault of a Child: A mother retained me to represent her 8-year-old son. The city charged his father with assaulting him. The mother did not wish her son to have to testify in court against his father. The father agreed to participate in a therapeutic program which would permit the son to tell the father, in the presence of counselors, how it felt to be assaulted. The prosecutor and defense reached a resolution that did not require the child to testify.
