SUCCESSFUL EXAMPLES OF PRETRIAL MOTIONS

Criminal Trespass:
A client was charged with criminal trespass at the airport. Under very questionable circumstances, the police failed to preserve videos of the alleged crime or of his arrest and booking. We investigated these circumstances, the number of video cameras in the airport where these activities took place, and interviewed non-governmental witnesses. The court dismissed the case pretrial for the State's failure to preserve evidence.

Violating an Anti-Harassment Order:
Our investigation showed the court had entered a permanent anti-harassment order without proof that our client had been served with the temporary order. The permanent order therefore was not valid. The court granted our motion to dismiss the charge.

Drug Charges: A search warrant for our client’s home was based on bank records the State obtained with Special Inquiry Judge Proceeding (SIJP). We submitted public disclosure requests to learn about the county’s use of SIJPs. Finding every judge in the county had approved subpoenas in this procedure, we won a change of venue to a different county to challenge the procedure. We then won a motion to require the judges to answer interrogatories regarding the county’s practice. Before a final ruling on the motion to suppress evidence, the State dismissed the charge.
