Appeals & Post-Conviction Relief

APPEALS

Any person convicted of a crime has a right to appeal to a higher court. An appeal reviews whether the trial was conducted properly under the law. If an error occurred at trial that could have affected the verdict, the appellate court will reverse the conviction.

An appeal requires very different skills than a trial. I challenge the law itself and the way the trial was conducted. The appellate court must have a legal reason to reverse a conviction. But I also tell my client's case in a way to persuade the court that it wants to reverse the conviction.

I often ask the appellate court to consider how the law applies to my client's specific case. I have extensive success in challenging a trial court's jury instructions as inadequate explanations of the law.

I have handled hundreds of criminal appeals in superior courts, the Washington Court of Appeals, the Washington Supreme Court, the United States Court of Appeals for the Ninth Circuit, and the United States Supreme Court. I am a founding member of the Washington Appellate Lawyers' Association. I am counsel of record in over 70 published opinions.

I am a Fellow in the American Academy of Appellate Lawyers, and a founding member of the Washington Appellate Lawyer's Association.
